Terms of Use and Community Rules
Last updated: 21 October 2026
Accepted version (immutable text file) (2026-10-21)
These terms govern the use of the OpSo app, the public card pages and related services. OpSo is currently free of charge. The German version is binding; the English and Turkish versions are translations. Mandatory consumer rights remain unaffected.
1. Provider and scope
The provider is the person named in the Legal Notice. Contact: info@opsolid.de. By creating an account or using OpSo you agree to these terms. Conflicting terms of the user do not apply unless we expressly agree to them. The contract language is German; the contract text is available at this address at any time.
2. Service
OpSo lets you create and share a digital business card, manage contacts and notes, connect with other users and exchange messages, follow trade fairs and design card pages. The scope of features is as shown in the app and may evolve. We owe provision in line with the state of the art, but not a particular feature set, uninterrupted availability or a particular result.
3. Free use, future fees
OpSo can currently be used free of charge. No purchase is currently possible and we collect no fees. Should we offer paid features or products in future (for example plans or a physical NFC card), we will do so only with clear advance notice, a separate order process showing the price and a button that unambiguously states the payment obligation (§ 312j German Civil Code), together with the consumer information then required, such as on the right of withdrawal. We will not silently turn a previously free action into a paid one. The NFC card waitlist is non-binding and creates neither an order nor a payment obligation.
4. Paid subscriptions (if offered)
- Everything is free today and no purchase is possible.
- If we offer subscriptions (for example “Pro” or “Studio” with more active cards), they are bought through Google Play (later Apple); the price and billing period are shown in the store before purchase. The store handles payment; we do not receive your payment card or bank details.
- Subscriptions renew automatically for the chosen period until you cancel in the store. Cancellation takes effect at the end of the paid period. Refunds follow the store’s rules and applicable law.
- Deleting your OpSo account does not cancel a store subscription: cancel it in the store first to stop future charges. A purchase linked to a deleted account cannot be restored into a newly created account.
- If a subscription ends, your cards are retained and published cards stay available; new cards and publishing are subject to the limits of your remaining plan. The store’s own terms and withdrawal information also apply to the purchase.
5. Account and duties
- You must be at least 16 and legally capable of contracting.
- Your details must be truthful and current. You are responsible for access to your email account, devices and active sessions and must tell us promptly of any misuse of your account.
- You may not impersonate others, circumvent access restrictions or usage limits, scrape the service, impair security or availability, or distribute malware.
- You may collect or share third parties’ business contact data only where you have a legal basis and meet any statutory information duties (see the Privacy Policy).
6. Your content and public cards
Your content remains yours. You grant us a simple, non-exclusive right, limited to the duration of use, to store, process, reproduce and make the content publicly available as needed to operate, secure and support the service. You assure us that you hold the necessary rights (texts, photos, logos, trademarks, videos, images of people).
A published card is intentionally accessible to its audience. Search engines, recipients and platforms may keep copies. Privacy and unpublish settings end our future delivery but cannot recall copies others have already made.
You are responsible for the content of your card. If you use the card in a business capacity, you may have your own provider-identification duties (for example an imprint under § 5 DDG). OpSo’s legal notice does not replace your own. You indemnify us against third-party claims based on unlawful content or infringements for which you are responsible and reimburse reasonable legal defence costs resulting from them.
7. Messages, community rules and moderation
By publishing content or sending a connection request or message, that content and your use of these functions are governed by these terms. Direct messages are meant for 1:1 communication between the participants. Do not assume a recipient will keep content confidential, and do not send personal data or media you may not share.
Prohibited content includes in particular: unlawful content; threats, harassment or hate; sexual exploitation or content involving minors; impersonation; spam, scams or malware; content infringing copyright, trademark, privacy or personality rights; and instructions for violence, abuse or other crimes.
Reporting and blocking. You can report users, cards or messages in the app and block other users, or write to us at info@opsolid.de. This is also our single point of contact for authorities and users. A report of unlawful content should include: the exact address or identifier of the content, why it is unlawful, and your name and email address. A block limits further interaction; it does not delete content already sent or copies received.
Measures. We review reports and, where reasonably necessary, may restrict visibility, remove content, limit features, or suspend or terminate accounts. We may keep relevant records while a report is reviewed or where we need them to establish, exercise or defend legal claims. We are not obliged to pre-screen all content.
Reasons and appeal. We tell the affected account about a material moderation decision with reasons, where practical and lawful. You can submit an appeal or context through the app’s support route or by email to info@opsolid.de. We may keep measures in place during review where needed to protect users or the service.
8. Custom domains and third-party services
You are responsible for registration, DNS account and your authority to use a hostname. A custom domain becomes active only after ownership, routing and TLS checks succeed. App stores, identity and DNS providers and optional integrations have their own terms and availability, which we do not control.
9. Availability and changes to the service
We work for secure and available operation but promise no uninterrupted operation. Maintenance, security incidents, networks and third-party services can cause interruptions. We may change, develop or discontinue features and reasonable usage limits; we announce material changes with reasonable notice in the app or by email. If we discontinue the entire service, we will give you the chance to export your data. We recommend backing up important data regularly using the export function; OpSo is no substitute for your own backups or legally required records.
10. Term, termination, suspension and deletion
The contract runs for an indefinite period. You can end it at any time by deleting your account in the app (or, without the app, via the Delete account page). We may terminate with four weeks’ notice in text form. The right to terminate for good cause remains unaffected, in particular for unlawful use, material breach of these terms, fraud, abuse or security risk. We may suspend an account temporarily as needed to address such cases and, where practical and permitted, explain this and offer a chance to respond.
On termination the deletion periods of the Privacy Policy apply: the account is deactivated immediately and permanently deleted within 30 days, subject to statutory retention duties and backup rotation.
11. Liability
We are liable without limit for intent and gross negligence, injury to life, body or health, under the Product Liability Act, for fraudulently concealed defects, under an assumed guarantee, and where mandatory law requires liability. For slightly negligent breach of an essential contractual duty (a duty whose fulfilment makes proper performance of the contract possible in the first place and on which you may regularly rely), liability is limited to the typical, foreseeable damage. Otherwise liability for slight negligence is excluded. This also applies for the benefit of our legal representatives and vicarious agents. We are not responsible for user content or for linked or embedded third parties; on learning of unlawful content we act in line with §§ 7 to 10 DDG.
12. Changes to these terms
We may change these terms for legal, security or product reasons. The version with the date above is current. We point out material changes in the app or by email and ask for your renewed agreement before you use protected functions (publishing, messages, connections); for this we store the version and checksum (SHA-256) of the document as contract evidence (see the Privacy Policy). If you do not agree, you cannot keep using those functions and can delete your account at any time. Agreement is a contractual act and not consent to independent data processing or to a payment.
13. Governing law, dispute resolution, final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers this choice of law applies only so far as it does not deprive them of the protection of mandatory provisions of the law of their country of habitual residence. For merchants, legal entities under public law and special funds under public law, Arnsberg is the exclusive place of jurisdiction where legally permitted; otherwise the statutory venues apply.
We are neither willing nor obliged to take part in dispute-resolution proceedings before a consumer arbitration board (§ 36 VSBG).
If a provision is invalid, the rest of the contract remains valid and the statutory rules apply. Send questions to info@opsolid.de.
